Swiftpage Anti-Spam Policy

. If anyone is found to have violated the following conditions, Swiftpage has the right to terminate service. Any account that is terminated for any reason relating to abuse will not receive a refund for services paid.

The Federal CAN-SPAM Act was put into effect on January 1st, 2004 – and penalties for violations range from $250 to $2 million and affect nearly everyone who sends email. Swiftpage’s policy also applies to anyone outside of the United States.

Swiftpage has a zero tolerance policy for any violation of the CAN-Spam Act such as:

  • Using subject lines that are deceptive or misleading
  • Falsifying from address and physical address
  • Not honoring any opt out that is initiated by a recipient that does not use the opt out link provided in the footer of every message sent from the system within 10 days

Any violations of the above, as well as other guidelines of the CAN-Spam Act will result in the termination of service.

In addition to adhering to Swiftpage’s anti-spam policy, all users must abide applicable regional laws.

Permission-based email addresses

The more time you take to build a permission-based list, the more responsive your list will be because they have requested to receive information from you. Every recipient of your email should have been clearly and fully notified of the collection and use of his or her email address and consented prior to such collection and use. Consent is not required to be in writing, but a traceable method of obtaining consent is recommended. How not to obtain email addresses

  • Purchasing an email list from a 3rd party vendor
  • Harvesting email addresses off the internet
  • Sending to email addresses such as: , , or any other general addresses

The right way to obtain email addresses

  • Being a customer of yours, past or current
  • Meeting someone and obtaining a business card
  • Signing up for a newsletter / has requested information from you

CAN-SPAM compliance

The most important aspect of the CAN-SPAM Act’s stipulations is the “opt-out” function that recipients can employ at any time, prohibiting companies from contacting them in the future. Once a person “opts-out” of an email from any company, the company as a whole must cease all email to that individual. This affects disparate sales people as well.

Swiftpage’s emarketing services include an opt-out link at the footer of every email that is sent out through our system. In addition, the suppression is managed on a Swiftpage server, meaning that the “opt-out” information is disseminated company-wide for those who use Swiftpage’s emarketing services, and even prohibits delivery to that list, regardless if your salesperson has requested delivery or not.

There is also a “Sent By” postal (physical) address in which your company’s information is always displayed at the footer of every email.
